Abstract

This book offers a new theoretical framework for free speech by critically analyzing the major justifications for free speech. Unlike most theories that justify free speech on single grounds, this book argues for a justification; namely the double grounded principled approach; that combines and revises the arguments of equal autonomy and democratic participation at the same time. It claims that a revised and critical blending of these two justifications can serve free speech to be grounded on strong principled arguments. The book has both a theoretical and practical focus: first, it discusses the conceptual circumstances of free speech and major theoretical justifications for free speech and then, it applies the developed theoretical framework to the cases of academic freedom, media freedom and hate speech separately. This volume will appeal to readers who are interested in general free speech theories as well as readers who look for an alternative view on specific topics such as academic freedom, media freedom and hate speech.

Abstract

How did the Huguenots of Paris survive, and even prosper, in the eighteenth century when the majority Catholic population was notorious for its hostility to Protestantism? Why, by the end of the Old Regime, did public opinion overwhelmingly favour giving Huguenots greater rights? This study of the growth of religious toleration in Paris traces the specific history of the Huguenots after Louis XIV revoked the Edict of Nantes in 1685. David Garrioch identifies the roots of this transformation of attitudes towards the minority Huguenot population in their own methods of resistance to persecution and pragmatic government responses to it, as well as in the particular environment of Paris. Above all, this book identifies the extraordinary shift in Catholic religious culture that took place over the century as a significant cause of change, set against the backdrop of cultural and intellectual transformation that we call the Enlightenment.

Abstract

Freedom of information (FOI) is now an international phenomenon with over 100 countries from Albania to Zimbabwe enacting the right to know for their citizens. Since 2005, the UK's Freedom of Information Act has opened up thousands of public bodies to unparalleled scrutiny and prompted further moves to transparency. This book provides a comprehensive guide to the practical management of freedom of information compliance, including interpretation of the Act as well as the Environmental Information Regulations. The UK Freedom of Information Act has now been in force for 12 years. Despite regular attempts to reform it most recently the government's establishment of an Independent FOI Commission in 2015/16 it has largely survived intact. This book documents best practice, the light that is cast by regulator guidance and case law, and the author's views on how FOI should be managed now that it has matured and become embedded in public authorities. It's hoped that the book will cement a positive approach to FOI in public bodies and help them to better meet their obligations. The Freedom of Information Officer's Handbook will be required reading for anyone responsible for, or involved with, managing compliance with FOI. The book will also cover FOI in other parts of the British Islands, so will be of interest to practitioners in the Isle of Man, Jersey, Scotland and Ireland. Abstract

The works translated here deal with two major themes in the thinking of St Augustine (354-430): free will and divine grace. On the one hand, free will enables human beings to make their own choices; on the other hand, God's grace is required for these choices to be efficacious. 'On the Free Choice of the Will', 'On Grace and Free Choice', 'On Reprimand and Grace' and 'On the Gift of Perseverance' set out Augustine's theory of human responsibility, and sketch a subtle reconciliation of will and grace. This volume is the first to bring together Augustine's early and later writings on these two themes, in a new translation by Peter King, enabling the reader to see what Augustine regarded as the crowning achievement of his work. Abstract

This book documents Japan's psychological deterioration caused by its defeat in August 1945. Also, Japan’s traumatic transformation from authoritarianism to democracy is detailed. The study exposes an ideological war between the Soviet Union and the USA within American-occupied Japan, which triggered violent polarization among the Japanese. Under General MacArthur’s tutorage, the defeated Japanese were expected to become a peace-loving people, but the Cold War derailed Japan’s progress toward freedom and democracy. The “Red Purge,” instituted by MacArthur's Headquarters (GHQ) from 1949 to 1950, triggered the devastating side effects on Japan's academic freedom and freedom of speech. Stanford University Professor Dr. Walter C. Eells (1886–1962) served at the GHQ as an influential education adviser and became the most vocal advocate of the Red Purge. Japanese Marxist historians have constructed the popular postwar narrative of the Red Purge, blaming the GHQ for every failure. The vast archival materials, including the GHQ papers, Eells papers, and Japanese-language documents, revealed that the Red Purge was a serious propaganda battle between the Americans and the Soviets in a war-torn Japan. This propaganda war engendered the violently polarized political climate, in which the conservative Japanese government behaved according to the dictates of US Cold War policy. By revealing feverish tensions within the GHQ regarding communist influences in Japanese universities, this study sheds bright new light on the Red Purge and its lasting impact on Japan's political future.

Abstract

This book critically examines the development of the 'stirring up hatred' offences which are currently found within the UK's Public Order Act 1986. Through a critical discourse analysis of key excerpts of parliamentary Hansard, the book constructs a detailed genealogy of the offences from the perspectives that shaped them. A novel application of theory on 'myth' is used to navigate the complex arguments and to trace ideas about identity and order across parliamentary debates, from fears of Fascism in the 1930s to condemnations of homophobia in the early 21st century. The story of the stirring up hatred offences told in this book therefore extends far beyond the traditional frame of a dilemma between regulating hate speech and safeguarding free speech: it is inextricably entwined with myths about law, race and national identity, and speaks to wider themes of coloniality, neoliberalism, white entitlement, British-Christian exceptionalism and the innocence of law. Written in an accessible and engaging style, this book challenges a wide range of assumptions about hate speech law and raises a series of considerations for developing forms of accountability that are less complicit in the harms that they are supposed to redress. Jen Neller is Lecturer in Law at Manchester Metropolitan University, UK, where she teaches Public Law and research methods. She is a co-author of the last two editions of Pearson's Law of the European Union textbook and has published in Critical Discourse Studies and the International Journal of Crime, Justice and Social Democracy. Jen obtained a PhD in law from Birkbeck University of London in 2020.

Abstract

This fresh and original book argues that the central questions in Hegel's practical philosophy are the central questions in modern accounts of freedom: What is freedom, or what would it be to act freely? Is it possible so to act? And how important is leading a free life? Robert Pippin argues that the core of Hegel's answers is a social theory of agency, the view that agency is not exclusively a matter of the self-relation and self-determination of an individual but requires the right sort of engagement with and recognition by others. Using a detailed analysis of key Hegelian texts, he develops this interpretation to reveal the bearing of Hegel's claims on many contemporary issues, including much-discussed core problems in the liberal democratic tradition. His important study will be valuable for all readers who are interested in Hegel's philosophy and in the modern problems of agency and freedom.
